CCTV and data protection
If your cameras record people, data protection law is likely to apply. This page explains the basics and where we can help.
Who is responsible
Once a system is installed, you are the one who decides what the cameras record and why, so you are responsible for using it lawfully. We install and set up the equipment and can advise, but we do not operate your system or look at your footage unless you ask us to help with a fault.
Homes
Cameras that only cover your own property, such as your garden and front door, are generally treated as personal use. If your cameras also capture a public street, a neighbour’s property or other people’s space, UK GDPR and the Data Protection Act 2018 are likely to apply. We can angle cameras and set privacy masks to reduce what is captured outside your boundary.
Businesses
If you use CCTV at a business, you should normally:
- be registered with the Information Commissioner’s Office (ICO) and pay the data protection fee, unless you are exempt;
- have a clear reason for the cameras, such as preventing crime or protecting staff and property;
- put up clear signs saying CCTV is in use, who runs it and how to contact them;
- keep a short written CCTV policy;
- keep footage secure, limit who can view it and delete it once it is no longer needed; and
- be ready to respond if someone asks for footage of themselves.
How long to keep footage
The law does not set a fixed period. You should keep footage for no longer than you need it, which is often a matter of weeks. We can set the recording storage to match the period you choose.
Cameras indoors and audio
Be careful with cameras in places where people expect privacy, such as toilets or changing areas, which are not suitable. Recording sound is more intrusive than video and is usually harder to justify, so we recommend turning audio off unless you have a clear need.
Intruder alarms
The intruder alarms we fit are self-monitored. Alerts go to you, not to an alarm receiving centre or the police. If your insurer requires a monitored alarm from a certified installer, please check with them before relying on our system.
Where to find out more
The ICO has guidance for both homes and businesses at ico.org.uk. This page is general information and is not legal advice. If you are unsure about your own situation, speak to the ICO or a solicitor. For anything about your installation, contact us on 01622 584332 or at support@techkent.co.uk.
